Decided: Diffenderfer v. Central Baptist Church - Should a church continue to receive a tax exemption for property that it is using for commercial rather than religious purposes? Citizens and taxpayers of Dade County, Florida filed a lawsuit, alleging that a Florida law which authorized a tax exemption for a church parking lot used for commercial purposes violated the Establishment Clause of the First Amendment.

The Supreme Court will not be able to rule on the merits of the case because, just before the District Court issues its ruling, the Florida Legislature repeals the law in question.

According to the Supreme Court, it has to rule on the law as it stands at the time that the case is brought to them rather than at the time that the case was originally filed.

Because the plaintiffs asked that the law be struck down, and the law no longer existed, there was really nothing for the Supreme Court to do.
